Density of liquor outlets (especially packaged liquor) has always been a concern of the Authority. Recently, we have seen density raised as a reason for refusal of packaged liquor licences in Sydney's eastern suburbs.
In a new decision, the Authority considered the density of packaged liquor outlets within the suburbs of Bonnyrigg (only 3 currently) as a reason for refusal. Other reasons included demographic data which suggests disadvantage in the area, crime hotspot maps and even close proximity to a high school.
While the decision to refusal was no doubt an aggregation of all these factors, it is unlikely that outlet density and demographic data for this suburb will change any time soon. Does this mean all future applications for bottle shops are doomed?
Not necessarily, but a high benchmark has been set and the onus is on the applicant to satisfy the Authority. Possible ways to address this are:
have a bespoke offering that differentiates from other outlets,
create an incredibly comprehensive plan of management tailored to the needs of the community,
have evidence of community support/need/benefit.
Most importantly, do your due diligence before selecting a site. Consider crime, health, demographic and outlet data from the outset. It might be safer to select a premises one or two kilometres away, but still within range of your customer base.
